Title: Prohibits a Local Government's Control Board from Banning a Fuel Source
Vote to concur with amendments and pass a bill that prohibits a local government's control board from passing any ordinances or policies that banned or had the effect of banning a particular fuel source.
Classifies "energy source" as (Sec. 1-1):
The method of generation; or
The fuel source; used to provide or supply utility service to a customer. The term includes any energy source used to provide utility service, including a clean energy resource.
Requires the commission to evaluate the impact of federal phaseout mandates on the estimated useful lives of both (Sec. 2.e):
The existing electric generating facilities of the electric utility; and
Any proposed electric generating facilities of the electric utility.
Specifies in acting upon any petition for the construction, purchase, or lease of any facility for the generation of electricity, the commission will take into account the following (Sec. 3.b):
The applicant's current and potential arrangement with other electric utilities for:
The interchange of power;
The pooling of facilities;
The purchase of power; and
Joint ownership of facilities. and
Other methods for providing reliable, efficient, and economical electric service, including the refurbishment of existing facilities, conservation, load management, cogeneration and renewable energy sources.
Requires that a particular component, design, or type of material be used in the construction of a building or other structure because of the energy saving or energy producing qualities of the component, design, or material (Sec. 4-1).
Prohibits the use of a particular component, design, or type of material in the construction of a building or other structure because the component, design, or material does not meet a standard for energy saving (Sec. 4-2).
Prohibits the sale, installation, or use of any of the following (Sec. 4-5):
Natural gas powered home heating equipment.
Natural gas powered home appliances.
Grills, stoves, and other food preparation appliances designed to be used outdoors.
Natural gas powered:
Heating appliances; and
Torches, lamps, and other decorative features; designed to be used outdoors.
