Title: Authorizes Victims in Personal Injury and Wrongful Death Cases to Collect Interest
Vote to concur with amendments and pass a bill that authorizes victims in personal injury cases and wrongful death cases to collect interest on money they receive from court for cases that reach a verdict.
Specifies that the following interest rates shall be implemented for court judgments (Sec. 5):
9% per annum from the date of judgment until judgment is satisfied; or
6% per annum when a judgment debtor is a unit of local government, school district, a community college district, or any other governmental entity, or if the judgment is made in a personal injury or wrongful death claim.
Establishes that plaintiffs may recover prejudgment interest in wrongful death or personal injury cases, and interest would accrue from the date the claim is filed (Sec. 5).
Specifies that prejudgment interest cannot accrue for a period longer than 5 years (Sec. 5).
