Title: Expands Legal Recourse Options for Oklahomans Censored by Social Media Platforms
Vote to pass a bill that expands legal recourse options for oklahomans censored by social media platforms.
Classifies a “social media website” as a website or application that enables users to communicate with each other by posting information, comments, messages or images and meets the following criteria (Sec. 1.A-6):
Is open to the public,
Has more than 75 million subscribers, and
Has not been specifically affiliated with any one political party or religion from its inception.
Establishes the owner or operator of a social media website who contracts with users in this state is subject to a private right of action by a social media website user if the social media website purposely (Sec. 1.B):
Deletes or censors a social media website user’s political speech or religious speech; or
Uses an algorithm to suppress political speech or religious speech.
Specifies damages available to a social media website user includes the following (Sec. 1.C):
A minimum of $75,000 per intentional deletion or censoring of the social media website user’s speech;
Actual damages,
Punitive damages if aggravating factors are present, and
Other applicable forms of equitable relief.
Specifies a social media website is immune from liability if it deletes or censors a social media website user’s speech or uses an algorithm to disfavor or censure speech that (Sec. 1.E-1):
Calls for immediate acts of violence;
Is obscene or pornographic in nature;
Was the result of operational error;
Was the result of a court order;
Came from an inauthentic source or involved false impersonation;
Enticed criminal conduct; or
Involved minors bullying minors.
Specifies only users who are 18 years of age or older have standing to bring an action pursuant to this section (Sec. 1-2.F).
Authorizes the Attorney General to bring a civil cause of action on behalf of social media website users who reside in this state whose political speech or religious speech has been censored by a social media website (Sec. 1-2.G).
