Title: Increases Penalties for School Bus Stop Arm Violations

  • Establishes the registered owner of a vehicle used to pass a school bus stopped on a roadway or a private road when the arm signal device 24 is in the device's extended position commits a Class B infraction (Sec. 1.f).

  • Specifies the following can be used as a defense to the above action (Sec. 1.g):

    • The vehicle was stolen from the registered owner and the registered owner can document the theft by presenting a police report;

    • The registered owner of a vehicle involved in the violation routinely engage in the business of renting the vehicle for periods of 30 days or less;

    • The registered owner of the vehicle involved in the violation is an employer who provided the vehicle for use by employees in the scope of their employment if the registered owner fully cooperates with law enforcement in the investigation and prosecution of a violation;

    • The Bureau of Investigations may not assess points under the point system for an infraction committed; and

    • An adjudication for an infraction committed does not create a presumption of liability in a civil action.

  • Establishes the registered owner of a vehicle used to pass a school bus stopped on a roadway or a private road when the arm signal device is in the device's extended position commits a Class B infraction. However, the violation is a Class A infraction if the registered owner has a prior (Sec. 1.f):

    • Adjudication for a violation; or

    • A conviction for a violation.
