Vote Smart's Synopsis:

Vote to pass a bill that requires transgender student athletes play against those of their biological sex.

Highlights:

• Defines “interscholastic” to mean a student representing the student’s school or local education agency (LEA) in a school athletic activity against another school or LEA (Sec. 1).

• Defines “school athletic activity” as an interscholastic or intramural athletic or sporting activity that an LEA sponsors (Sec. 1).

• Defines “sex” as the biological, physical, condition of being male or female, determined by an individuals genetics and anatomy at birth (Sec. 1).

• Requires a public school, LEA, or private school that competes against a public school or LEA expressly designate school athletic activities as one of the following, based on sex (Sec. 2):

• Male or boys;

• Female or girls; or

• Coed or mixed.

• Prohibits a student of the male sex from participating in a school athletic activity desingated for females (Sec. 2).

• Prohibits a government entity or licensing or accrediting organization from entertaining a complaint, opening an investigation, or take any adverse action against a school or LEA for maintaining separate school activities for students of the female sex (Sec. 2).

• Authorizes a student who is deprived of an athletic opportunity or suffers any direct or indirect harm as a result of a knowing or willful violation of the aforementioned requirements  to take action for injunctive relief, damages, and any other relief available against the school or LEA that caused the deprivation or harm within 2 years of the harm occurring (Sec. 3).
