Vote to pass a bill that amends sentencing guidelines for state prisoners who were sentenced before new sentencing guidelines were passed, to have an opportunity for resentencing.

Highlights:

• Authorizes eligibility for state prisoners to be resentenced if they were incarcerated for nonviolent offenses according to the statutory sentencing range or the Habitual Felony Offender Act before October 1st, 2013 (Pg. 2).

• Authorizes a defendant or the Department of Corrections to file a motion for reduction in sentence if the covered offense occurred before October 1st, 2013, and the defendant demonstrated behavior that would prove his or her fitness for resentencing, accompanied by evidence of the fact (Pg. 3). 

• Specifies a motion for sentence reduction cannot be entertained if a previous motion for sentence reduction has been denied or if the individual is not currently serving their sentence in a Department of Corrections Facility (Pg. 4).
