Title: Protects Businesses from Civil Lawsuits Arising from COVID-19

Highlights:

 

  • Establishes any person who conducts normal business operations or on the premises owned or operated by the person has a defense to civil liability for ordinary negligence for any personal injury or death resulting from COVID-19, if the person acts as any person would have acted under the same or similar circumstances (Sec. 1-2).

  • Establishes a rebuttable presumption that the safety measures adopted by any person are reasonable if those measures conform to the Centers for Disease Control and Prevention guidelines in existence at the time of the alleged exposure (Sec. 1-3).

  • Specifies unless expressly prohibited by law or an executive order related to school closure, a public school official's good faith decision to open or close a school in the legally uncertain environment created by COVID-19 shall be deemed a discretionary act to determine qualified immunity (Sec. 2).
