  • Defines a covered entity as (Sec. 2): 

    • A business entity;

    • A health care provider;

    • An educational entity;

    • A church;

    • A governmental entity;

    • A cultural institution; or

    • Any director, officer, trustee, manager, member, employee, or agent of the covered entity for any act or omission performed while acting on behalf of the covered entity.

  • Establishes freedom from liability for negligence, premise liability, or for any non-wanton, non-willful, or non-intentional civil cause of action relating to COVID-19 unless the claimant shows by clear and convincing evidence that the covered entity did not reasonably attempt to comply with the then applicable public health guidance (Sec. 4).

  • Provides covered entities with liability from damages from mental anguish, emotional distress, or punitive damages (Sec. 4).

  • Specifies that ‘wanton, reckless, willful or intentional misconduct’ disqualifies health care workers from liability (Sec. 5).
