Highlights:

 

  • Specifies that an open enrollment transfer request must be requested for a period of longer than one year (Sec. 1-6).

  • Amends the words ‘voluntary diversity plan’ or ‘court-ordered desegregation plan’ to ‘desegregation order’ (Sec. 2-6).  

  • Authorizes school superintendent’s to deny open enrollment transfer requests if they prohibit the facilitation of a desegregation order, unless (Sec 3 a.):

    • The transfer is requested and submitted to the district  in a timely manner, i.e. before March 1st of the previous school year; or 

    • The pupil to be transferred has a sibling who is already participating in an open enrollment transfer 

  • Allows parents of children whose transfer request has been denied under the school’s implementation of the desegregation order to appeal the school superintendent’s decision to the district board, and further appeal it to the District court if the appeal is denied by the district board (Sec. 3b) 

  • Requires the board of directors of a school district to create an objective policy for the implementation of open enrollment in their district (Sec. 3c).
