Title: Increases Autonomous Vehicle Delivery
Vote to pass a bill that increases autonomous vehicle delivery.
Defines “personal delivery device as" using the following criteria (Sec. 1-51):
It’s manufactured for transporting cargo and goods;
It’s equipped with automated driving technology, including software and hardware, that enables the operation of the device with remote support and human supervision; and
Does not include a personal mobile cargo carrying device.
Defines "local authority" as any county, municipal or other local board or body exercising jurisdiction over highways under the constitution and laws of this state (Sec. 2-38).
Specifies a personal delivery device that is operated in compliance with this bill is not a vehicle (Sec. 4-28-1222.B).
Requires a personal delivery device to incorporate the following (Sec. 4-28-1224):
Ensure the safety of pedestrians;
Yields to and does not obstruct the right-of-way of traffic;
Does not “unreasonably interfere” with traffic;
Displays lights at nighttime;
Complies with regulations of local authorities;
Does not transport hazardous materials;
Is monitored and controlled.
Requires a personal delivery device to be equipped with the following (Sec. 4-28-1226):
A marker that clearly states the name and contact information of the owner and unique identification number; and
A braking system that enables the device to come to a controlled stop.
Requires a personal delivery device operating at nighttime be equipped with lights at the front and rear that are recognizable under normal atmospheric conditions and visible from 500 feet away (Sec. 4-28-1226).
Prohibits a local authority from regulating a personal delivery device on a highway or pedestrian area inconsistent with this bill, unless (Sec. 4-28-1227):
It affects peace officers ability to enforce laws related to the personal delivery device; and
It prevents safe operation of other personal delivery devices in a specified zone
Requires a business entity that operates a personal delivery device to maintain an insurance policy that includes general liability coverage of at least $100,000 for damages arising from the operation of the device (Sec. 4-28-1228).
