Highlights:

 

  • Amends the Pennsylvania Constitution to ensure questions of adjournment or termination or extension of a disaster emergency declaration as declared by executive order or proclamation, or portion of a disaster emergency declaration as declared by executive order or proclamation, will to be presented to the Governor and before it takes effect be approved by him, or being disapproved, must be reposed by two-thirds of both Houses (Sec. 1-1.1).

  • Restructures the Pennsylvania Constitution through a proposed amendment by adding the following (Sec. 1-2):

    • Emergency declarations declared by executive order must show that the occurrence or threat of a disaster is imminent that threatens the health, safety or welfare of this Commonwealth;

    • The executive order must indicate the nature, each area threatened and the conditions of the disaster, including whether the disaster is a natural disaster, military emergency, public health emergency, technological disaster or other general emergencies;

    • The executive order will be in effect for no more than 21 days; and

    • The Governor may not issue a new disaster emergency declaration based upon the same or substantially similar facts and circumstances without the passage of a concurrent resolution.

NOTE: AN AMENDMENT TO THE CONSTITUTION IS A THREE-STEP PROCESS. FIRST, IT REQUIRES APPROVAL OF A MAJORITY IN BOTH THE HOUSE AND SENATE. SECOND, FOLLOWING AN ELECTION YEAR IT REQUIRES ANOTHER MAJORITY VOTE BY THE NEXT GENERAL ASSEMBLY, AND THIRD, APPROVAL BY THE VOTERS DURING A GUBERNATORIAL ELECTION.
