Title: Amends State Drunk Driving Laws and Penalties

Vote to pass a bill that amends state drunk driving laws and penalties.

Highlights:

  • Expands imposition of active sanctions by the department for a conviction of any offense under federal, state, or another state’s controlled substances laws. The driver record will be changed to indicate the active departmental sanction has ended and specifies that the following still apply (Sec. 2):

    • If the ending of the active departmental sanction means a driver's operating privilege is eligible for restoration, no points will be placed on the driver record; and

    • If a driver record shows a pending departmental sanction after the active sanction imposed by the department for a conviction of any offense under federal, state or another state's controlled substance laws. the effective dates of the pending departmental sanction will be adjusted as if the active sanction ended under this subsection had been rescinded from the record.

  • Requires the program to be available to an individual who meets the following criteria (Sec. 2.D):

    • The individual’s operating privilege has been indefinitely suspended;

    • The individual’s operating privilege will be or is suspended for a conviction;

    • The individual has served any operating privilege suspension required by the underlying offense; and

    • The individual has submitted a completed application for relief to the department on a form prescribed by the department.

  • Establishes relief from the Administrative Suspension Program, and specifies that (Sec. 2.2):

    • the program shall permit the department to restore the operating privileges of eligible individuals from suspensions;

    • the individual has served any operating privilege suspension required by the underlying offense; and

    • the individual has submitted a completed application for relief to the department on a form prescribed by the department. the following items must also be submitted with the application.

 

  • Prohibits individuals from receiving relief under the program for convictions of violations committed (Sec. 2.2).
