Title: Prohibits Direct or Indirect Ownership of Motor Vehicle Service and Repair Facilities by Motor Vehicle Manufacturers
Vote to pass a bill that prohibits direct or indirect ownership of motor vehicle service or repair facilities by motor vehicle manufacturers.
Highlights:
Specifies “Successor Manufacturer” means a manufacturer that acquires, succeeds to, or assumes any part of the business of another manufacturer as the result of any of the following (Sec. 6.4):
Change in ownership, operation, or control of a predecessor manufacturer;
Termination, suspension, or cessation of business operations;
Discontinuing sale of product line; or
Chance in distribution systems of manufacturers.
Prohibits a manufacturer from doing any of the following (Sec. 14.1):
Adopts, changes, establishes, or implements an arbitrary or capricious plan to distribute motor vehicles to dealerships;
Fails to advise or disclose allocation or distribution plans to dealerships;
Refuses to deliver to a dealership within a reasonable time of the after receipt of the dealer’s order;
Increases or reduces price after the sale of the vehicle. Does not apply to:
Motor vehicle equipment
Foreign-made vehicles or components
Transportation charges
Prohibits, prevents, or attempts to prevent new motor vehicle dealers from transferring a dealership to or naming a spouse, chile or executive manager as dealer successor (Sec.14.z).
