Highlights:

 

  • Amends the definition of “electric vehicle” to include hybrid electric vehicles and specifies that it does not include qualified motor vehicles (Sec. 3).

  • Defines “electric vehicle road use fee” as an annual fee in place of a tax on alternative fuels assessed upon electricity used in electric vehicles (Sec. 3).

  • Requires the owner of an electric vehicle to submit an electric vehicle road fee upon initial registration and annually each year after in order to stay registered (Sec. 4).

  • Specifies that the aforementioned registration shall not be complete until payment of the electric vehicle road fee (Sec. 4).

  • Establishes the following electric vehicle road fees based on the following weights (Sec. 4):

    • $15 per year for electric motorcycles and neighborhood electric vehicles;

    • $75 per year for hybrid electric vehicles and electric motorcycles with a gross vehicle weight rating of not more than 26,000;

    • $175 per year for electric vehicles and motorcycles with a gross vehicle weight rating of over 26,000; and

    • $250 per year for any electric vehicles and motorcycles with a gross vehicle weight rating of 26,001 or more.

  • Specifies that funds collected from the aforementioned fees shall be deposited into the motor license fund for purposes of aligning the electric vehicle road use fee with allocations of proceeds, and must be allocated in accordance with the oil company franchise tax for highway maintenance and construction (Sec. 4).

  • Prohibits exempt entities from paying the electric vehicle road use fee (Sec. 4).

  • Defines “exempt entity” as an individual exempt from reporting and paying a tax on liquid fuels, fuels, or alternative fuels imposed (Sec. 4).

  • Requires an exempt entity that has an electric vehicle registered and uses the electric vehicle for nonexempt purposes during the registration year to pay an administrative penalty of $500 to the department of transportation (Sec. 4).

  • Requires an exempt entity who is seeking a refund for the aforementioned penalty to provide written records of vehicle usage, certifying that an individual trip made by the vehicle was for a qualified exempt use (Sec. 4).

  • Specifies that this act shall take effect immediately upon passage (Sec. 5).
