Vote to pass a bill that establishes limited civil liability to agritourism activity providers that fail to notify of potential dangers.

Highlights:

• Exempts agritourism activity providers from civil liability charges for injuries or damages to a participant if (Sec 3):

• At the time of the activity, a warning sign was posited in accordance with regulations; and

• The provider entered into a written agreement with the participant in accordance with regulations.

• Defines agritourism activity as any activity that takes place on agricultural land and allows members of the general public to tour, explore, observe, learn about, participate in, or be entertained by an aspect of agricultural production, harvesting, husbandry, or rural lifestyle that occurs on the farm (Sec 2).

• Specifies that an agritourism activity provider is not exempt from civil liabilities due to the injury or damages to a participant if the provider (Sec 3):

• Performs an act in a grossly negligent manner;

• Purposefully causes injury or damages to a participant;

• Acts or fails to act in a way that constitutes criminal conduct; or

• Recklessly fails to warn or guard against a dangerous condition.

• Requires an activity provider to post a sign with a warning notice in a clearly visible location at or near the entrance of the site (Sec 4).

• Requires the participant to sign a written agreement prior to participating in the activity (Sec 5).
