A vote to concur with senate amendments and pass a bill that authorizes convicts of marijuana misdemeanors to apply for expungement.

Highlights:

• Specifies that beginning January 1, 2020, any individual convicted of one or more misdemeanor marijuana offenses may apply to set aside the conviction or convictions for expungement under this act (Sec. 1e).

• Requires an applicant for the aforementioned expungement to provide all of the following information, including (Sec. 1e):

• Their full name and current address of the applicant; and

• A certified record of each conviction that is to be set aside.

• Authorizes the prosecuting agency of the marijuana offense that is sought to be expunged by the applicant to rebut the expungement and present evidence that the conviction or convictions constitute a criminal violation that would have occurred on or after December 6, 2018 (Sec. 1e).

• Requires a convicting court that is presented with a prosecuting agency’s rebuttal to provide after 21 days and no later than 60 days after a prosecuting agency has filed the rebuttal (Sec. 1e).
