Title: Establishes Restitution for Victims of Police Violence

Vote to pass a bill that establishes excessive use of force by a peace officer as a crime eligible for victim compensation.

Highlights:

 

  • Requires applications for restitution to be accepted if an application for a claim is based on injury or death that happened as a result of a crime (Sec. 2).

  • Prohibits the denial of an application for a claim based solely upon the contents of a police report or lack thereof (Sec. 2).

  • Authorizes the following factors to be used in determining whether to accept a claim (Sec. 2):

    • A written statement provided by a victim services provider who has provided services to the victim;

    • A statement provided by a credible witness to the crime;

    • A permanent restraining order meant to protect the victim from the perpetrator;

    • A statement from a health provider documenting that the victim experienced physical, mental or emotional injury as a result of the crime;

    • Video, audio or photographic recording of the crime; or

    • Any other reliable evidence that the board finds relevant to a crime.

  • Establishes that this bill takes effect immediately upon passage (Sec. 3).
