Title: Establishes a System of Paid Family and Medical Leave Insurance

Vote to override a veto of a bill that establishes a system of paid family and medical leave insurance by taking 0.5% out of an employees payroll to create a fund for all workers.

Highlights:

 

  • Authorizes state and nongovernmental employers to participate in a self-insured plan if requested by the employer upon their application and certification as long as it provides equal benefits to all employees (Ch. 282-B).

  • Requires state and nongovernmental employers to remit FMLI premium payments on a calendar quarterly basis (Ch. 282-B):

    • Payments are 0.5 percent of wages per week per employee.

  • Requires the Family and Medical Leave Insurance Fund Administration to create an insurance fund for deposits of insurance payments (Ch. 282-B:4).

  • Requires the employee to file an application 30 days before the leave will begin unless the leave was not foreseeable at the time and provide their employer with written notice (Ch. 282-B:5).

  • Limits an employee to 12 weeks of FMLI in any benefit year if they have had premium payments remitted as a percent of his or her wages for at least 6 months and have worked resulting in wages in the amount of at least $1040 multiplied by the minimum wage in either the base period or alternative base period (Ch. 282-B:6).]

  • Requires an advisory counsel to quarterly review and evaluate family medical leave insurance, and after 2 years of administration,  the commissioner shall provide the general court with rate adjustments or a fiscal recommendation (Ch. 282-A:128). 

  • The bill authorizes the State Treasurer to transfer General Funds in the amount of $3.5 million to the Department of Employment Security in the first year the program becomes operational, and $12 million of General Funds in the second year of operation for payment of the initial administrative and implementation costs (pg.6).
