Title: Authorizes County Commissioners to Reopen Counties

Vote to pass a bill that authorizes local county commissioners to reopen businesses in counties during a health emergency if certain criteria are met.

Highlights:

 

  • Authorizes the governing body of a county, in consultation with the county emergency management agency, county health department, and county health officer, to develop and implement a countywide reopening plan for businesses subject to closure by the governor due to the spread of a communicable disease during a public health emergency (Sec 1).

  • Authorizes the governing body of a county, in consultation with the county emergency management agency and appropriate health or emergency management officials, to take any action to modify the countywide reopening plan for businesses to expand or restrict the industries authorized to operate in the county or rescind the countywide opening entirely (Sec 1).

  • Prohibits counties from (Sec 1):

    • Requiring a county to rescind a local declaration of emergency relating to a communicable disease; or

    • Revoking, rescinding, or overruling the proclamation of disaster emergency issued by the governor on March 6, 2020, and any renewal of the state of disaster emergency.
