Vote to pass a bill that authorizes certain flavors of vape products and prohibits advertisements comparing vape and tobacco products.

Highlights:

• Prohibits vapor product retailers from advertising vapor products in a manner that causes a minor to believe health benefits may be derived from the use of the product, and from promoting the product by comparing its health effects with the health effects of tobacco products (Sec. 1).

• Requires individuals who violate the advertising and promotion provisions to be responsible for a state civil infraction and authorizes civil fines (Sec. 1):

• For a 1st offense, not more than $500 in a calendar year;

• For a 2nd offense, not more than $1,000 in a calendar year; and

• For a 3rd or subsequent offense, not more than $2,500 in a calendar year.

• Specifies that the flavors tobacco, menthol, and fruit or a combination of common fruits, are not considered to be appealing to minors (Sec. 1).
