Vote Smart's Synopsis:

Vote to pass a bill that requires police officers to intervene when a fellow officer is engaging in misconduct.

Highlights:

• Requires police officers to intervene to prevent or stop another officer engaging in misconduct, and to report the misconduct to a supervisor within 72 hours of the incident (Sec. 2).

• Defines “misconduct” as behavior including, but not limited to (Sec. 2):

• Unjustified or excessive force;

• Any violations of the use of force policy;

• Sexual harassment;

• Discrimination based on race, color, religion, sex, sexual orientation, national origin, disability, or age; or

• Any crime.

• Authorizes the Department of Public Safety Standards and Training and the respective law enforcement unit to suspend or revoke an officer’s certification for failure to intervene in or report misconduct (Sec. 2).

• Prohibits employers from discriminating or retaliating against a police officer with regard to promotion, compensation, or other terms, conditions, or privileges of employment for intervening in or reporting misconduct (Sec. 2).

• Requires the Department of Public Safety Standards and Training to report on any rules adopted to implement this bill at least annually (Sec. 2).
