Title: Extends Sexual Battery Prosecution Time Limitations

Vote to pass a bill that establishes exceptions to general time limitations allowing prosecution to be commenced at any time for specified sexual battery offenses against victims younger than a certain age.

Highlights:

 

  • Establishes that prosecutions are subject to the following periods of limitation (Sec. 2):

    • A prosecution for a first-degree felony must be commenced within four years after its occurrence;

    • A prosecution for any other felony must be commenced within three years after its occurrence;

    • A prosecution for a first-degree misdemeanor must be commenced within two years after its occurrence; and

    • A prosecution for a second-degree misdemeanor or noncriminal violation must be commenced a year after its occurrence.

  • Establishes that if a minor was the victim of any offense that occurred on or after July 1, 2020, the prosecution may be commenced at any time (Sec. 2). 

  • Establishes that this bill takes effect on July 1, 2020 (Sec. 3).
