Vote to pass a bill that increases penalties for trespassing on animal agriculture operations.

Highlights:

 

  • Prohibits a person from interfering with an official act of the Department of Agriculture and Land Stewardship, taken in the performance of a duty to prevent or control the transmission of infectious or contagious disease among a population or species of animals, if the official act is authorized as part of any of the following (Se. 9):

    • Veterinary emergency preparedness and response service;

    • A foreign animal disease preparedness and response strategy; or 

    • An emergency measure.

  • Specifies that a person who interferes with an official act will be subject to a civil penalty of between $100 and $10,000 (Sec. 11).

  • Specifies that a person commits food operation trespass by entering or remaining on the property of a food operation without consent by the owner or authority of the establishment (Sec. 17).

  • Specifies that a person who commits food operation trespass is guilty of an aggravated misdemeanor upon their first offense (Sec. 18).

  • Specifies that for a second or subsequent offense, a person who commits food operation trespass is guilty of a class “D” felony (Sec. 18).

  • Defines “food operation” as any of the following (Sec. 17):

    • A location where a food animal is produced, maintained, otherwise housed or kept, or produced in any manner; 

    • A location other than as described in the above sub-highlight where a food animal is kept, including in apiary, livestock market, vehicle or trailer, fair, exhibition, or a business operated by a person licensed to practice veterinary medicine; 

    • A location where a meat food product, poultry product, milk or milk product, egg or an egg product, aquatic product, or honey is prepared for human consumption, including a food processing plant or slaughtering establishment; or

    • A food establishment or farmers market that sells meat, poultry, milk product, egg product, aquatic product, or honey.

  • Authorizes a person to destroy feral swine if they are on the person’s property or damaging the person’s personal property (Sec. 10)
