Title: Increases Penalties for Eluding Law Enforcement
Vote to pass a bill that increases the criminal penalties for eluding law enforcement officers.
Specifies that a driver commits a class “D” felony if they willfully fail to bring their motor vehicle to a stop, or otherwise elude or attempt to elude a marked law enforcement vehicle, and in doing so exceeds the speed limit by 25 miles per hour or more and if any of the following occurs (Sec. 1):
The driver is participating in a public offense that is a felony;
The driver is in violation of operating a vehicle while under the influence of alcohol or a drug, or while they have a blood alcohol concentration of .08 or more;
The driver is in violation of manufacturing, delivering, or possessing a controlled substance; or
The offense results in bodily injury to another person.
Specifies that the driver of a motor vehicle who commits a second or subsequent violation of the above-mentioned highlight is guilty of a class “C” felony upon their conviction (Sec. 1).
Prohibits a driver of a motor vehicle from willfully failing to bring their motor vehicle to a stop or otherwise eluding or attempting to elude a marked law enforcement vehicle driven by a uniformed officer after being given a visual and audible signed to stop (Sec. 1).
Specifies that a second or subsequent violation of the above-mentioned prohibition is guilty of an aggravated misdemeanor upon their conviction (Sec. 1).
