  • Specifies that a driver commits a class “D” felony if they willfully fail to bring their motor vehicle to a stop, or otherwise elude or attempt to elude a marked law enforcement vehicle, and in doing so exceeds the speed limit by 25 miles per hour or more and if any of the following occurs (Sec. 1):

    • The driver is participating in a public offense that is a felony;

    • The driver is in violation of operating a vehicle while under the influence of alcohol or a drug, or while they have a blood alcohol concentration of .08 or more;

    • The driver is in violation of manufacturing, delivering, or possessing a controlled substance; or

    • The offense results in bodily injury to another person.

  • Specifies that the driver of a motor vehicle who commits a second or subsequent violation of the above-mentioned highlight is guilty of a class “C” felony upon their conviction (Sec. 1).
