Highlights:

 

  • Authorizes the following self-service, terminal-generated lottery games to lottery sales agents that hold a class C or D liquor permit for the location at which the games are offered, including games that (Sec. 3770.03, Pg. 38):

    • Offer instant-win-style lottery games and drawing style-lottery games;

    • Contain the ability to be played at multiple ticket prices, betting types, and payouts established by the State Lottery Commission; and

    • Are available on the interactive self-service terminals, which are not considered video lottery terminals and do all of the following:

      • Allow gameplay in a graphical, paperless, interactive format;

      • Allow a player to initiate, play, and view the game, including the reveal of the result, on the self-service terminal from which the game is purchased;

      • Give the player the option to receive any winnings either through the terminal or using a paper pay voucher to be redeemed with a lottery sales agent; and

      • Be available on other lottery terminals and devices, including clerk-facing lottery terminals.

  • Authorizes sports gaming in the state and defines it as accepting wagers on sporting events by any system or method the Commission approves, including the following (Sec. 3770.30, Pg. 40):

    • Purchasing lottery tickets whose prize determinations are based on exchange wagering;

    • Parlays, over-under, money line, or in-game wagering,

    • Single-game bets, teaser bets, in-play bets, or proposition bets; and

    • Pools, pari-mutuel sports wagering pools, or straight bets.

  • Exempts a vendor who provides sports gaming equipment to a licensed sports gaming agent from being considered a sports gaming agent (Sec. 3770.30, Pg. 41).

  • Defines “sports gaming agent” as a casino operator or video lottery sales agent licensed as a sports gaming agent to offer sports gaming in this state and specifies that it does not include a veteran’s or fraternal organization that contracts with a sports gaming agent to offer sports gaming in the organization’s facility (Sec. 3770.30, Pg. 41). 

  • Specifies that sports gaming will not include pari-mutuel betting on the outcome of a horse race, video lottery terminals, other lottery games of the state lottery, casino gaming, or fantasy contests (Sec 3770.30, Pg. 41).

  • Defines “sports gaming equipment”any mechanical, electronic, or other device, mechanism, or equipment, including a personal device, related software, materials, or supplies that are used or consumed in the operation of sports gaming (Sec. 3770.30, Pg. 42).

  • Defines a “sports governing body” as a regional, national, or international organization having ultimate authority over the rules and codes of conduct with respect to a sporting event and the participants in that sporting event (Sec. 3770.30, Pg. 42).

  • Defines a “video lottery sales agent” as an agent of the state lottery authorized to operate an electronic device approved by the state lottery Commission that provides immediate prize determinations for participants on an electronic display (Sec. 3770.30, Pg. 42).

  • Defines a “wager” as purchasing as sports gaming lottery ticket through which a sum of money or thing of value is risked on an uncertain occurrence (Sec. 3770.30, Pg. 43).

  • Authorizes the Commission to adopt the following rules concerning sports gaming, including (Sec. 3770.31, Pg. 43):

    • Procedures for accepting wagers on a sporting event or series;

    • The maximum wager that a sports gaming agent may accept from one individual;

    • The types of wagering tickets to be used;

    • The manner in which tickets are issued;

    • The type of records to be kept by sports gaming licensees;

    • The system to be used to place a wager;

    • Protections for a player placing a wager;

    • Measures to promise responsible gaming;

    • Penalties and fines for violating this act; and

    • A prohibition against sports gaming advertising targeting individuals under 21 years of age.

  • Authorizes the Commission to allow a sports gaming agent to accept wagers on sporting events online over the internet from individuals who are physically present in the state (Sec. 3770.31, Pg. 44).

  • Authorizes the Commission to independently, or at the request of a sports governing body, adopt rules to prohibit or restrict wagering on a particular type of sporting event or to prohibit or restrict a particular type of wager (Sec. 3770.31, Pg. 44).

  • Authorizes the Commission to determine an individual’s eligibility to hold or renew a sports gaming license and maintain a record of all sports gaming licenses issued under this act (Sec. 3770.31, Pg. 45).

  • Authorizes the Commission to levy and collect fees on all surcharges and civil penalties imposed under this act and deposit all money collected into the sports gaming revenue fund (Sec. 3770.30, Pg. 45).

  • Authorizes the Commission to adopt rules and standards for advertising used in the promotion of a sports gaming event and establish its own advertising to generate funding to deposit into the sports gaming revenue fund (Sec. 3770.31, Pg. 46).

  • Requires each individual applying for a sports gaming license to submit a complete set of fingerprints directly to the superintendent of the bureau of criminal identification for the purpose of conducting a criminal background check (Sec. 3770.32, Pg. 46).

  • Requires the Commission to make anonymized sports gaming data available to sports governing bodies in real-time through the monitoring system in order to ensure the integrity of sports gaming (Sec. 377.31, Pg. 46).

  • Requires the sports gaming agent to pay a nonrefundable renewal fee of $100,000 or one percent of the sports gaming agent total gross receipts received from the operation of sports gaming in this state during the previous year, whichever is less (Sec. 3770.33, Pg. 51).

  • Authorizes the Commission to issue sports gaming occupational licenses which shall permit the licensee to be employed in the capacity the Commission designates in the duration of the license (Sec. 3770.35, Pg. 56).

  • Requires an individual applying for an occupational license or their employer pay a nonrefundable fee of $100 (Sec. 3770.35, Pg. 56).
