Vote to amend and pass a bill that authorizes retailers to deliver alcohol to residents.

Highlights:

 

  • Establishes a statewide, centralized application process for the application and renewal for retail licenses and permits (Sec. 1). 

  • Authorizes the following alcohol sales per the passage of a referendum (Sec. 2):

    • Alcohol for consumption on the premises on Sundays from 12:30 PM to 12:00 AM;

    • Package sales of malt beverages and wine on Sundays from 12:30 PM to 11:30 PM.; and

    • Alcohol at bars that serve food on Sundays from 11:00 AM to 12:00 AM.

  • Requires the election superintendent of a county to hold an election on such referendums between 10-60 days of when the resolution authorizing the referendums is passed (Sec. 2).

  • Authorizes free samples of alcoholic beverages, as long as someone is present (Sec. 5).

  • Establishes that this bill takes effect immediately upon passage (Sec. 8).

Highlights:

 

  • Authorizes a packaged goods retailer to deliver alcoholic beverages in unbroken packages lawfully sold to and purchased by an individual for personal use under the following conditions (Sec 1):

    • Individuals making the purchase have established an account with the packaged goods retailer;

    • The packaged goods retailer or employee shall process all payments from the individual transacting the purchase with the packaged goods dealer;

    • The packaged goods retailer will fulfill each order at their licensed premises with only inventory from the premise; and

    • Once the order leaves the premises the alcoholic beverage will remain in the possession of the person that is to make the delivery until it is delivered. 

  • Specifies that deliveries shall not be made under any of the following conditions (Sec 1):

    • No individual is at the address to accept the delivery;

    • The individual accepting the delivery is under the age of 21 years old;

    • The individual cannot provide proper identification to verify their age;

    • The individual fails to provide a signature that matches their identification; or 

    • The individual appears intoxicated.

  • Authorizes packaged goods retailers to use electronic means to market, receive, and process orders for alcoholic beverages it is licensed to sell (Sec 1). 

  • Authorizes a fine of $500 for each violation of the delivery requirements of alcoholic beverages (Sec 1). 

  • Specifies that the ability to deliver alcoholic beverages may be suspended upon violation of delivery requirements (Sec 1).
