Title: Increases Penalties for Selling or Possessing Drugs Near Schools

Vote to pass a bill that increases criminal penalties for selling or possessing drugs near school property.

Highlights:

 

  • Specifies that a person who is guilty of possessing or purchasing from a person one or more of the following controlled substances on or within 1,000 feet from the property of a public or private elementary or secondary school will be guilty of a felony and punished by imprisonment for up to 5 years (Sec. 1):

    • Methamphetamine; 

    • Heroin; 

    • Cocaine; or

    • Fentanyl.

  • Specifies that the above-mentioned provisions do not apply to a person who is (Sec. 1):

    • Less than 18 years of age; 

    • 18 years of age or older who is enrolled as a full-time student at a public or private secondary school located within the prohibited distance; or

    • Within the prohibited distance at the request of a law enforcement officer for purposes of conducting a routine traffic stop.

  • Requires any person convicted of any offense described above to, in addition to any fine imposed, pay a special assessment trauma-care fee of $100 to be deposited into the Trauma Care Assistance Revolving Fund (Sec. 1).
