Title: Prohibits Abortion if Roe v Wade is Overturned by the Supreme Court
Vote to pass a bill that prohibits abortions if Roe v Wade is overturned by the United States Supreme Court.
Authorizes the state of Idaho to criminalize abortion if the Supreme Court restores state authority to prohibit abortion (Sec 1).
Authorizes the state of Idaho to criminalize abortion if the United States Constitution is amended to restore the state’s authority to prohibit abortion (Sec 1).
Defines “criminal abortion” as every person who performs or attempts to perform an abortion (Sec 1).
Classifies criminal abortion as a felony punishable by at least 2 years and no more than 5 years in prison as well as be suspended by the appropriate licensing board for 6 months (Sec 1).
Specifies various exemptions to the term criminal abortion, including (Sec 1):
A physician determined the abortion to be necessary to prevent the death of the pregnant woman;
A physician performed the abortion in order to end the pregnancy as an attempt for the fetus to survive and reduce the risk of death for the pregnant woman;
If the abortion was performed after the woman has reported the act of rape or incest to law enforcement and the report is shared with the physician;
If the abortion is performed on a minor either she or her parent or guardian may report the act of rape or incest to law enforcement and share the report with the physician; or
Women who receive medical treatment provided by a healthcare professional that results in the accidental death or unintentional injury of the fetus.
