Highlights:

• Authorizes the state of Idaho to criminalize abortion if the Supreme Court restores state authority to prohibit abortion (Sec 1). 

• Authorizes the state of Idaho to criminalize abortion if the United States Constitution is amended to restore the state’s authority to prohibit abortion (Sec 1). 

• Defines “criminal abortion” as every person who performs or attempts to perform an abortion (Sec 1). 

• Classifies criminal abortion as a felony punishable by at least 2 years and no more than 5 years in prison as well as be suspended by the appropriate licensing board for 6 months (Sec 1). 

• Specifies various exemptions to the term criminal abortion, including (Sec 1):

• If the abortion was performed after the woman has reported the act of rape or incest to law enforcement and the report is shared with the physician;

• If the abortion is performed on a minor either she or her parent or guardian may report the act of rape or incest to law enforcement and share the report with the physician; or

• Women who receive medical treatment provided by a healthcare professional that results in the accidental death or unintentional injury of the fetus.
