Title: Prohibits Employment Discrimination Based On Criminal History Background

Vote to pass a bill that prohibits employment discrimination based on an applicants criminal history.

Highlights:

 

  • Prohibits an employer or an employment agency from (Sec.1 ):

    • Posting language in a job listing that seeks to exclude an applicant with a criminal conviction; 

    • Asking an applicant about a criminal conviction on a job application form; or

    • Inquiring about or into, considering, or requiring disclosure of the criminal conviction record of an applicant until the applicant has been determined qualified for the position and notified that the applicant has been selected for an interview by the employer or employment agency, or if there is not an interview, until after a conditional offer of employment is made to the applicant by the employer or employment agency. 

  • Specifies that the above-mentioned prohibitions do not apply to the following situations (Sec. 1):

    • If federal, state, or local law requires the consideration of an applicant’s criminal history; 

    • To an employer that is a law enforcement agency; 

    • To an employer in the criminal justice system; or 

    • To an employer seeking a nonemployee volunteer.
