Title: Amends Constitution by Authorizing Wagering on Sporting Events

Vote to pass a resolution that authorizes a potential constitutional amendment by process of proposing and submitting to the voters a referendum concerning wagering on sporting events and revising provisions regarding certain municipal proceeds of gaming revenues.

Highlights:

 

  • Requires, at the next general election held in South Dakota, the amendments outlined in the following highlights from section 2 of this bill, to Article III of the state constitution, to be submitted to the electors of the state for approval (Sec. 1).

  • Authorizes bona fide veterans, charitable, educational, religious or fraternal organizations, civic and service clubs, volunteer fire departments, and other public spirited organizations to conduct games of chance if the entire net proceeds are given to educational, charitable, patriotic, religious, or other public spirited uses (Sec. 2). 

  • Prohibits state lottery games and video games of chance that are regulated, owned, and operated by the state of South Dakota to directly dispense coins or tokens (Sec. 2). 

  • Requires the Legislature to establish the portion of proceeds due the state from such lottery or video games of chance, or both, and the purposes for which those proceeds are to be used (Sec. 2). 

  • Authorizes the Legislature to authorize by law, roulette, keno, craps, wagering on sporting events, limited card games, and slot machines within the city limits of Deadwood (Sec. 2). 

  • Requires the entire net Municipal proceeds of such roulette, keno, craps, wagering on sporting events, card games, and slot machines to be given to the Historic Restoration and Preservation of Deadwood (Sec 2).

NOTE: AN AMENDMENT TO THE CONSTITUTION REQUIRES MAJORITY APPROVAL IN EACH CHAMBER FOR PASSAGE. AN AMENDMENT MAY ALSO BE PROPOSED BY INITIATIVE PETITION. IT MUST THEN BE APPROVED BY A MAJORITY OF CITIZENS VOTING IN THE NEXT ELECTION TO BECOME ENACTED.
