Title: Requires County Jails Comply with ICE Detainer Requests

Vote to pass a bill that requires county jails to comply with federal Immigration and Customs Enforcement's (ICE) immigration detainer requests, effective November 1, 2020.

Highlights:

 

  • Requires all sheriffs, jailers, prison keepers and their deputies who have custody of an individual subject to an ICE immigration detainer request to (Sec. 1):

    • Comply with, honor and fulfill any request made in the immigration detainer request; and

    • Inform the individual identified in the immigration detainer request.

  • Exempts a sheriff, jailer, prison keeper and their deputies who have custody of an individual subject to an ICE immigration detainer request from being required to comply with the detainer request if the individual has provided proof that they are a citizen of the United States (Sec. 1).

  • Specifies that such proof of citizenship may include the following (Sec. 1):

    • An Oklahoma driver license or identification card issued by the Department of Public Safety on or after November 1, 2007; or

    • A state or federal government-issued identification.

  • Defines “immigration detainer request” as a federal government request to a local entity to maintain temporary custody of an undocumented immigrant (Sec. 1).
