Title: Rights for Transportation Security Officers Act

Vote to pass a bill that amends workplace rights, protections, and benefits applicable to Transportation Security Administration (TSA) personnel.

Highlights:

  • Requires the labor organization certified by the Federal Labor Relations Authority on June 29, 2011, or a successor labor organization, to be treated as the exclusive representation of full- and part-time non-supervisory TSA personnel carrying out screening functions (Sec. 5).

  • Specifies that any current collective bargaining agreement covering TSA personnel will remain in effect until the conversion of internal policies (Sec. 5).

  • Requires the Secretary of Homeland Security (DHS) to take all actions necessary to ensure (Sec. 4):

    • Any annual leave, sick leave, or other paid leave accrued, accumulated, or otherwise available to a covered employee before the conversion to new policies will remain available to the employee until used; and 

    • The government share of any premiums or other periodic charges governing group health insurance will remain at least the same as was the case immediately before the conversion to new policies. 

  • Defines “covered position” as a position within the TSA, and “covered employee” as an employee who holds a covered position (Sec. 2).

  • Specifies that any TSA personnel management system in use for covered employees on the day before this bill goes into effect will not be modified (Sec. 3).

  • Prohibits any TSA personnel management policy or guidance established in the Aviation and Transportation Security Act that was not established before this bill’s date of enactment from being implemented (Sec. 3).

  • Repeals all TSA personnel and human resources management policies 180 days after this bill’s date of enactment (Sec. 3).

  • Requires the Comptroller General to submit a report to Congress on the differences in rates of pay, classified by pay system, between TSA employees (Sec. 4):

    • With duty stations in the contiguous 48 states; and

    • With duty stations outside of such states, including those employees located in any territory or possession of the US. 

  • Requires the TSA Administrator to engage and consult with public and private entities associated with the Federal Air Marshall Service to address concerns regarding mental health, suicide rates, morale and recruitment, and any other appropriate personnel issues (Sec. 10).

  • Requires the TSA Administrator, in coordination with the Director of Centers for Disease Control and Prevention and the Director of the National Institute of Allergy and Infectious Diseases, to ensure that covered employees are provided proper guidance regarding prevention and protection against the coronavirus (Sec. 13).

  • Requires the DHS Secretary to prioritize the hiring of veterans and widows of veterans for covered positions (Sec. 12).

  • Prohibits covered employees from installing or using the social media video application “TikTok” on US-issued mobile devices (Sec. 11).
