Ryan Kerby voted Yea (Passage) on this Legislation.
Title: Prohibits Gender Change on Birth Certificates
Vote to pass a bill that prohibits gender changes on birth certificates.
Requires any birth certificate issued under the provisions of this act to include the quantitative statistics and material facts specific to that birth (Sec. 2):
Time of birth;
Date of birth;
Sex;
Birth weight;
Birth length; and
Place of birth.
Defines “sex” as the biological and physiological characteristics, specifically the chromosomes and internal and external reproductive anatomy, genetically determined at conception and generally recognizable at birth, that define an individual as male or female (Sec. 2).
Authorizes after one year, the quantitative statistics and material facts identified above to be challenged in court only on the basis of fraud, duress, or material mistake of fact, with the burden of proof on the challenging party (Sec. 2).
Specifies that the legislature finds that allowing individuals to alter their birth certificates based upon subjective feelings for experiences underminds the government’s interest in having accurate records (Sec. 1).
