Title: Requires Warning Labels on Pornography

Vote to amend and pass a bill that requires a visible warning be put on pornography.

Highlights:

 

  • Prohibits a person who predominantly distributes or provides pornographic material to consumers with the intent to earn revenue or profit directly or indirectly from the distribution, from distributing any pornographic material or performance without giving a clear and reasonable warning of the harmful impact of exposing minors to the material or performance (Sec. 3).

  • Requires that for print publications created after May 12, 2020, the warning must be placed in clear, readable type on the cover of each publication containing pornographic material (Sec. 3).

  • Requires that for digital publications, the warning must be displayed in searchable text format and for at least 5 seconds prior to the display of any video or each image which includes pornographic material (Sec. 3).

  • Specifies that a person in violation of the first highlight will be liable for a civil penalty no greater than $2,500 per violation, plus filing fees and attorney fees, in addition to any other penalty established by law (Sec. 3).

  • Specifies that the conditions of this act do not apply to certain internet service providers, as explained under Section 78B-6-2102 of Utah Code (Sec. 1).

  • Specifies that a person who predominantly distributes or provides pornographic material to consumers with the intent to earn revenue or profit directly or indirectly from the distribution, without a warning label, is not liable if the person demonstrates reasonable efforts to determine the location of recipients of pornographic material in the state and the placement of warning label on materials that enters the state (Sec. 1).
