Title: Establishes Regulations for Pesticides

Vote to pass a bill that establishes regulations and penalties for pesticide usage.

Highlights:

 

  • Authorizes the state chemist to require the submission of the complete formula of a pesticide product including the safety data sheet, a physical sample of the product, and a statement of all claims to be made for the pesticide product, including a full description of the tests made results upon which the claims are based (Sec. 10).

  • Authorizes the state chemist to impose the following civil penalties under this act (Sec. 11):

    • $300 for a person’s first violation;

    • $600 for a person’s second violation; and

    • $1,200 for a person’s third and each subsequent violation. 

  • Establishes the civil penalty advisory panel to study and recommend a point system for use in determining the civil penalties that may be imposed for a violation of this act (Sec. 19).

  • Specifies that the following individuals will compose of the panel, including (Sec. 19):

    • The director of the Department of Agriculture or the director’s designee; 

    • The state chemist or the state chemist’s designee; 

    • 9 members as appointed by the governor;

    • 2 members as appointed by the senate; and

    • 2 members as appointed by the house of representatives.
