Title: Authorizes Temporary Seizure of Guns from Persons Posing Substantial Risk
Vote to pass a bill that authorizes the removal of firearms from persons posing substantial risk of injury to themselves or others.
Authorizes a judge, upon finding that there is probable cause to believe that a person poses a substantial risk of personal injury to themself or others in the near future by such person’s possession of a firearm, to issue an ex parte emergency substantial risk order (Sec. 1).
Specifies that such an order will prohibit the person who is subject to the order from purchasing, possessing, or transporting a firearm for the duration of the order (Sec. 1).
Specifies that a violation of this prohibition is a Class 1 misdemeanor (Sec. 1).
Requires the Department of State Police to keep and maintain a computerized Substantial Risk Order Registry for the entry of orders issued pursuant to this act (Sec. 1).
