Title: Prohibits Use of Animal Testing on Manufacturer Products Sold in the State
Vote to pass a bill that prohibits animal tested products from being sold in the state.
Defines “animal test” as the internal or external application of a cosmetic, either in its final form or any ingredient thereof, to the skin, eyes, or other body parts of a live, non-human vertebrate (Sec. 5).
Specifies that the above prohibition does not apply to the following (Sec. 5):
An animal test of any cosmetic that is required by a state or federal regulatory authority, if each of the following applies:
An ingredient is in wide use and cannot be replaced by another ingredient capable of performing a similar function;
A specific human health problem is substantiated and the need to conduct animal tests is justified and supported by a detailed research protocol proposed as the basis for the evaluation; and
There is no non-animal alternative method accepted for the relevant endpoint by the relevant state or federal regulatory authority.
Specifies that a violation of this act will be punishable by an initial civil penalty of $5,000 for the first day of each violation and an additional civil penalty of $1,000 for each day the violation continues (Sec. 5).
