Title: Prohibits Municipal Governments from Requiring Approval for Tree Removal
Vote to pass a bill that prohibits municipal governments from requiring notices, applications, approvals, permits, fees, or mitigation for pruning, trimming, or removal of trees on residential property.
Prohibits a local government from requiring a notice, application, approval, permit, fee, or mitigation for the pruning, trimming, or removal of a tree on residential property if the residential property owner obtains documentation from a certified arborist that the tree presents a danger to their livelihood or property (Sec. 1).
Prohibits a local government from requiring a property owner to replant a tree that was pruned, trimmed, or removed in accordance with this act (Sec. 1).
Specifies that this act does not affect the authority of the delegated mangrove protections (Sec. 1).
Establishes a state property owners bill of rights and specifies that rights and protections shall include the following (Sec. 2):
Right to acquire, possess, and protect your property;
Right to use and enjoy your property;
Right to exclude others from your property;
Right to dispose of your property;
Right to due process;
Right to just compensation for property taken for a public space; and
Right to relief or payment of compensation, when a new law, rule, regulation, or ordinance of the state or a political entity unfairly affects your property.
