Title: Establishes Employment Protections for Pregnant Women
Vote to pass a bill that prohibits pregnancy-related discrimination and establishes other provisions to protect pregnant women in the workplace.
Defines “employer,” for the purpose of determining accommodations for pregnant employees, as a person who has 15 or more employees for each of 20 or more calendar weeks during the year (Sec. 1).
Defines “reasonable accommodations” for pregnant employees as the following (Sec. 1):
More frequent or longer breaks;
Time off to recover from childbirth;
Acquisition or modification of equipment;
Appropriate seating;
Temporary transfer to a less strenuous or hazardous position;
Job restructuring;
Light duty;
Modified work schedule; and
Private space that is not a bathroom for expressing breast milk.
Specifies that it is unlawful for an employer to fail to make reasonable accommodations for any employee with limitations related to pregnancy, childbirth, or a related medical condition, unless the employer can demonstrate that the accommodation would impose an undue hardship on their program, enterprise, or business (Sec. 2).
Requires employers to engage in a timely and interactive process with employees to determine effective reasonable accommodations (Sec. 2).
Requires employers to provide written notice of the right to reasonable accommodations for pregnancy, childbirth, and related medical conditions to new and existing employees (Sec. 2).
