Vote to pass a bill that requires doctors to inform a patient seeking an abortion of potential abortion reversal drugs.

Highlights:

 

  • Requires the Department of Health to publish in English and Spanish, in a typeface large enough to be clearly legible, and in an easily comprehensible format both of the following (Sec. 1):

    • Materials designed to inform a pregnant individual of the possibility of reversing the effects of an abortion that utilizes mifepristone if they change their mind; and

    • Information and assistance with the resources that may be available to help reverse the effects of an abortion that utilizes mifepristone.

  • Prohibits any physician from knowingly performing or inducing a mifepristone abortion without the physician or an agent of that physician doing both of the following (Sec. 1):

    • Informing the patient, at least 24 hours prior to providing the patient with mifepristone, of both of the following:

      • It may be possible to reverse the intended effects of a mifepristone abortion if they change their mind, but that is time is of the esense;

      • Information on and assistance with reversing the effects of the mifepristone abortion is available on the Department of Health’s website, and requires the physician to give the patient the link to the page on the website where the information and assistance is available; 

    • Immediately prior to providing the patient with the mifepristone, providing them with printed materials that include the following statement:

      • "Recent developing research has indicated that mifepristone alone is not always effective in ending a pregnancy. It may be possible to avoid, cease, or even to reverse the intended effects of an abortion utilizing mifepristone if the second pill has not been taken. Please consult with a health care professional immediately."

  • Specifies that anyone who violates the above highlight is guilty of failture to disclose the reversibility of a mifepristone abortion, a misdemeanor of the first degree on a first offense, and a felony of the fourth degree on each subsequent offense (Sec. 1).

  • Defines “mifepristone abortion” as an abortion that involves a regimen of taking mifepristone first, then one or more subsequent dangerous drugs (Sec. 1).

  • Authorizes a patient on whom a mifepristone abortion was performed, to file a civil action for the wrongful death of their unborn fetus and may receive $10,000 in damages (Sec. 1).
