Title: Increases State Smoking Age
Vote to pass a bill that increases the legal smoking age from 18 to 19.
Classifies the use of cigarettes, cigars, or electronic nicotine delivery systems by anyone under the age of 19 as a Class V misdemeanor (Sec. 1).
Specifies that a person may be free from prosecution for this crime if they provide evidence for the conviction of the person that sold them the product (Sec. 1).
Defines “electronic nicotine delivery system” as any product or device containing nicotine, tobacco, or tobacco derivatives that uses a mechanism to heat the substance and deliver it in a form that is meant to be inhaled (Sec. 2).
Classifies the distribution of any form of tobacco, cigarette, cigarette paper, electronic nicotine delivery system, or alternative nicotine product to a person under the age of 19 as a Class III misdemeanor (Sec. 3).
Requires any person selling electronic nicotine delivery systems to obtain the same kind of license required from those selling cigarettes, cigars, and other tobacco products (Sec. 4).
