Highlights:

 

  • Requires the DNA collection of any person that has been charged with a felony offense as a first offender or under conditional discharge (Sec. 1). 

  • Requires all DNA samples to be destroyed within 30 days of the receipt of the following (Sec. 3):

    • A court order reversing the conviction;

    • Documentation from the prosecuting attorney stating that charges were dismissed;

    • A judgement of acquittal;

    • A sentencing order showing that all felony charges were reduced to misdemeanors; or

    • A court order showing the successful completion of the sentence.
