Title: Authorizes the Delivery of Marijuana

Vote to pass a bill that authorizes regulated marijuana seller to deliver marijuana.

Highlights:

 

  • Expands the powers and duties of state licensing authority to include promulgating rules for the requirements of the delivery of marijuana and marijuana-infused products, including (Sec. 1 & 2):

    • Qualifications and eligibility requirements for various marijuana centers, stores, and transporters applying for a medical marijuana delivery permit and/or a retail marijuana delivery permit;

    • Training requirements for personnel who will deliver marijuana, as well as requirements for obtaining a responsible vendor designation before conducting a delivery;

    • Procedures for proof of medical marijuana registry and age identification and verification;

    • Security requirements;

    • Delivery vehicle requirements, including proper surveillance;

    • Record-keeping requirements;

    • Limits on the amount of products that can be in a vehicle and delivered to an individual;

    • Inventory tracking system requirements;

    • Health and safety requirements for products delivered;

    • Confidentiality requirements;

    • An application fee and annual renewal fee for the various permits;

    • The permitted hours of delivery;

    • Requirements for areas where orders are stored, weighed, packaged, prepared, and tagged; and

    • Payment methods. 

  • Expands the power of local licensing authorities to include the issuance of medical marijuana delivery permits (Sec. 3).

  • Specifies that the state licensing authority will, after receiving an application for original licensing or issuance of a retail marijuana delivery permit or renewal of an existing license or permit for any marijuana establishment, provide within 7 days a copy of the application to the local jurisdiction where the establishment will be located, unless the local jurisdiction prohibits the operation of retail marijuana establishments (Sec. 4).

  • Authorizes a medical marijuana delivery permit to a medical marijuana center license which in turn authorizes the permit holder to deliver medical marijuana and medical marijuana-infused products (Sec. 5).

  • Authorizes a retail marijuana delivery permit to a retail marijuana store license, which in turn authorizes the permit holder to deliver retail marijuana and retail marijuana products (Sec. 6).

  • Authorizes a medical marijuana delivery permit to a medical marijuana transporter license, which in turn authorizes the permit holder to deliver medical marijuana and medical marijuana-infused products (Sec. 7).

  • Authorizes a retail marijuana delivery permit to a retail marijuana transporter license, which in turn authorizes the permit holder to deliver retail marijuana and retail marijuana products (Sec. 8).

  • Requires licensed medical marijuana centers and licensed retail marijuana stores to charge a one-dollar surcharge for each delivery, which will be remitted for local law enforcement costs related to marijuana enforcement (Sec. 5 & 6).

  • Establishes that both medical marijuana delivery permits and retail marijuana delivery permits are valid for one year, after which the permits can be renewed on an annual basis upon renewal of a medical marijuana center license, medical marijuana transporter license, retail marijuana store license, or retail marijuana transporter license (Sec. 5-8).

  • Specifies that the delivery of medical marijuana or medical marijuana-infused products, or the delivery of retail marijuana or retail marijuana products, is not allowed in any municipality, county, or city unless the municipality, county, or city votes to allow it (Sec. 5-8).

  • Authorizes the state licensing authority to issue medical marijuana delivery permits to qualified medical marijuana center applicants beginning January 2, 2020 (Sec. 5).

  • Authorizes the state licensing authority to issue medical marijuana delivery permits and retail marijuana delivery permits to qualified retail marijuana store applicants, qualified medical marijuana transporter applicants, and qualified retail marijuana transporter applicants beginning January 2, 2021 (Sec. 6-8).

  • Appropriates $390,152 to the department of revenue from the marijuana cash fund for the 2019-2020 fiscal year, in order to implement this act (Sec. 10).
