Highlights:

 

  • Requires broadband internet service providers to develop statewide reasonable network management practice plans for monitoring broadband internet that comply with the internet service net neutrality requirements established under this act (Sec. 3).

  • Defines “broadband internet access service” as a mass-market retail service that provides the capability to transmit and receive data from all internet endpoints, but shall not include dial-up internet access service (Sec. 1).

  • Defines “broadband internet service provider” as any person, business, or organization qualified to do business in this state, including municipal broadband providers that provide individuals, corporations, or other entities with broadband internet access service (Sec. 1).

  • Defines a “reasonable network management practice” as a practice that is primarily used for and tailored to achieving a legitimate network management purpose that does not (Sec. 5):

    • Block lawful content, applications, services, or non-harmful devices subject to reasonable network management;

    • Impair or degrade lawful internet service traffic on the basis of internet content, application, service, or non-harmful device; or

    • Engage in paid prioritization, including traffic shaping, prioritization, resource reservation, or other forms of preferential traffic management.
