Vote to concur with senate amendments and pass a bill that increases state consumer protection laws.

Highlights:

• Specifies that an individual will be guilty of deceptive trade practices when over the course of the individual’s business they do any of the following, including, but not limited to (Sec. 2):

• Knowingly or recklessly pass goods, services, or property as those of another;

• Knowingly or recklessly represent falsely the source, sponsorship, or certification of goods, services, or property;

• Knowingly or recklessly represent falsely the affiliation, connection, or association with or certification by another;

• Knowingly or recklessly fail to identify flood-damaged goods, water-damaged goods, or the results of a radon test and thus the need for radon mitigation; or

• Knowingly or recklessly engage in any unfair, unconscionable, deceptive, deliberately misleading, false or fraudulent act or practice.

• Defines “recklessly” to mean complete disregard for the truth or falsity of a statement or advertisement (Sec. 2).

• Authorizes the state attorney general or district attorney to bring a civil action and civil penalty of no more than $20,000 to any individual who violates or causes another to violate the above mentioned provisions (Sec. 3).
