Title: Amends the Procurement of Domestic Products Act

A vote to pass a bill that amends the Procurement of Domestic Products Act in order to enhance investment in American-made products by state agencies.

Highlights:

 

  • Requires procured products manufactured in the United States to be specified and purchased unless the purchasing agency determines the price of the products exceeds the price of available and comparable products manufactured outside the US by 12 percent or more (Sec. 10).

  • Specifies that the purchasing agency must first obtain a written waiver from the chief procurement officer (Sec. 10). 

  • Defines “manufactured in the United States” as meaning (Sec. 5):

    • In the case of products that are not assembled articles, materials, or supplies, that the produce is mined or produced in the United States;

    • In the case of assembled articles, materials, or supplies, that design, final assembly, processing, packaging, testing, or other process that adds value, quality, or reliability occurs in the US and the cost of domestic components exceeds 50 percent of the cost of all of the components; or 

    • That the produce is a commercially available off-the-shelf item.
