Title: Venezuela TPS Act of 2019

Vote to pass a bill that authorizes nationals of Venezuela to be eligible for temporary protected status.

Highlights:

 

  • Specifies that an immigrant who is a national of Venezuela is deemed to satisfy the requirements of the Immigration and Nationality Act, if the immigrant meets the following requirements (Sec. 2):

    • They have been continuously physically present in the United States since the enactment of this act;

    • They are admissible as an immigrant and are not ineligible for temporary protected status; and 

    • They register for temporary protected status in a manner established by the Secretary of Homeland Security. 

  • Requires the Secretary to give prior consent to travel abroad, in accordance with the Immigration and Nationality Act, to an immigrant who is granted temporary protected status, if the immigrant establishes satisfactory evidence that emergency and extenuating circumstances beyond the control of the immigrant requires them to depart for a brief, temporary trip abroad (Sec. 2).

  • Requires an immigrant returning to the United States to be treated as any other immigrant provided temporary protected status (Sec. 2). 

  • Authorizes the Secretary to charge and collect a $360 fee for each application for temporary protected status (Sec. 2).
