Highlights:

  • Authorizes any owner or operator of a critical infrastructure facility to file a civil action against anyone who willfully damages the critical infrastructure facility (Sec. 2307.67).

  • Defines “critical infrastructure facility” as a facility completely enclosed by a fence or other physical barrier that is obviously designed to exclude intruders, or if clearly marked with signs that are reasonably likely to come to the attention of potential intruders and that indicates entry is forbidden without site authorization, including, but not limited to (Sec. 2911.21):

    • A natural gas company facility or interstate natural gas pipeline;

    • A gas processing plant, including a plant used in the processing, treatment, or fractionation of natural gas or natural gas liquids;

    • A crude oil or refined products storage and distribution facility;

    • Any above-ground portion of an oil, gas, hazardous liquid or chemical pipeline, tank, or other storage facility; and

    • A natural gas company that is a public utility under section 4905.02 of the Revised Code.

  • Defines "organization" as a corporation for profit or not for profit, partnership, limited partnership, joint venture, unincorporated nonprofit association, estate, trust, or other commercial or legal entity, and does not include an entity organized as or by a governmental agency for the execution of a governmental program (Sec. 2901.23).

  • Specifies that any person or organization that provides compensation for the damages incurred to a critical infrastructure facility can still be vicariously liable for any judgment the prosecutor has against the individual who damaged the critical infrastructure facility (Sec. 2307.67).
