  • Defines “detention facility” as any building, facility, or structure used to detain individuals, not including State work release centers, or juvenile or adult residential treatment facilities (Sec. 10).

  • Prohibits the State, any unit of local government, any county county sheriff, or any agency, officer, employee, or agent from (Sec. 15):

    • Engaging in any agreement with a private entity for the ownership, management, or operation of detention facilities;

    • Paying, reimbursing, subsidizing, or defraying any costs connected to the sale, purchase, construction, development, ownership, management, or operation of a detention facility that is or will be owned, managed, or operated by a private entity;

    • Receiving any payment connected to the detention of individuals in a detention facility owned, managed, or operated by a private entity; or

    • Providing any monetary incentive or benefit to any private entity or person connected to the sale, purchase, construction, development, ownership, management, or operation of a detention facility that is or will be owned, managed, or operated by a private entity.

  • Authorizes the State, a unity of local government, or any sheriff that owns, manages, or operates a detention facility to have contracts with private entities or persons for the purpose of providing ancillary services in that facility (Sec. 20).

  • Specifies that this Act will control if there is a case in which this Act conflicts with any other law (Sec. 25).
